Terms of Service

1. Acceptance of Terms

By creating an account or using Bye Bye Mails (“the Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. We may update these Terms from time to time. We will notify you of significant changes at least 14 days in advance.

2. Description of the Service

Bye Bye Mails is an AI-powered email assistant that connects to your email account to:

• Read and classify your incoming email
• Generate daily briefings summarizing what matters
• Provide a chat interface to ask questions about your email
• Generate draft replies for your review and approval
• Send replies on your behalf when you approve them or enable autonomous mode

The Service operates alongside your existing email client. It does not replace your email provider.

3. Account Registration

To use the Service, you must:

• Be at least 13 years old (or 16 in the European Union)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately if you suspect unauthorized access

You are responsible for all activity under your account.

4. Email Access and Authorization

4.1 What You Authorize

When you connect your email account, you grant Bye Bye Mails permission to:

• Read your email messages and metadata
• Send email on your behalf (only when you approve a draft or enable autonomous mode)
• Manage labels and organizational actions on your email

You can revoke these permissions at any time by disconnecting your email account.

4.2 Autonomous Mode

When you enable autonomous mode (Level 2 or higher):

• The AI may send replies to certain categories of email without individual approval
• You define the rules and categories the AI may act on
• You can review all autonomous actions in the audit log
• You can disable autonomous mode instantly, at any time

5. AI-Generated Content

5.1 Nature of AI Responses

AI-generated content may contain errors, inaccuracies, or misinterpretations. Specifically:

• The AI may misclassify the urgency or category of an email
• The AI may misunderstand the context or intent of a message
• Draft replies may not accurately reflect what you would say
• Briefing summaries may omit relevant details

5.2 Sensitive Content

The AI does not have specialized knowledge in legal, medical, or financial domains. Exercise extra caution when the AI processes email related to:

• Legal matters (contracts, disputes, compliance)
• Medical or health information
• Financial transactions, tax documents, or investment decisions
• Confidential business or employment matters

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Send spam, phishing, or malicious email
• Attempt to access another user's data or account
• Reverse-engineer, decompile, or extract the source code of the Service
• Use automated scripts or bots to exceed normal human usage
• Use the Service as a proxy for AI processing unrelated to your email
• Interfere with or disrupt the Service or its infrastructure
• Resell or commercially exploit the Service without written permission

7. Intellectual Property

7.1 Your Data

You own your email data. Connecting your email does not transfer ownership to us.

7.2 Our Service

The Service, including its software, design, algorithms, AI prompts, branding, and documentation, is our intellectual property.

7.3 Feedback

If you provide suggestions or feedback, we may use it to improve the Service without obligation to you.

8. Pricing and Payment

The Service is currently free. If we introduce paid features in the future:

• Core features will remain free
• Paid features will be clearly identified before purchase
• You will never be charged without explicit consent
• We will provide at least 30 days' notice before pricing changes affect existing features

9. Service Availability

We strive for reliability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, outages, or third-party issues. We are not liable for losses resulting from unavailability.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided “as is” and “as available” without warranties of any kind
• We do not warrant that the AI will always produce accurate or error-free results
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to the amount you have paid us in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Bye Bye Mails from any claims arising from your use of the Service, violation of these Terms, or content sent via the Service on your behalf.

12. Termination

12.1 By You

You can terminate your account at any time. All data is permanently deleted within 30 days, and OAuth tokens are immediately revoked.

12.2 By Us

We may suspend or terminate your account if you violate these Terms, pose a security risk, or we are required to by law. We will provide reasonable notice when possible.

13. Dispute Resolution

We encourage you to contact us at support@byebyemails.com to resolve disputes informally. If we cannot, both parties agree to binding arbitration under the American Arbitration Association rules. You retain the right to bring claims in small claims court.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States.

15. Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bye Bye Mails.
